Maine packaging EPR

Status: Implementation later.

Who must comply

Maine's program is not yet implemented, so there is no compliance timeline to meet today. The statute covers producers of covered packaging sold into the state, and the USAEPR checker screens brand owners and US importers as its starting point. Until a stewardship organization is selected and a timeline exists, the checker shows Maine as "Not yet determinable" regardless of the figures entered, and this state requires agency review in any case.

Exemption thresholds

No numeric exemption test is screened for Maine, because the program cannot yet be calculated. The statute exempts producers under $2M gross revenue (temporarily $5M) or under 1 ton — but no stewardship organization has been selected (the Aug 2026 RFP got no proposals; DEP is revising the RFP), so no compliance timeline exists yet. Those statutory figures describe the eventual exemption shape, not a result you can rely on today.

Key dates

There is no compliance timeline yet. The Aug 2026 request for proposals for a stewardship organization received no proposals, and the Department of Environmental Protection is revising the RFP. Watch for the revised RFP and the stewardship selection before expecting registration or reporting dates.

What to confirm

Confirm the temporary revenue exemption period and the DEP RFP and stewardship selection status before relying on any Maine figure. Maine's numbers in this guide are the statute's shape, not an active calculation.
