Colorado packaging EPR
Status: Active, fees from Jan 2026.
Who must comply
Colorado's program covers producers of covered packaging sold into the state. The USAEPR checker screens brand owners and US importers as its starting point, because EPR duties usually fall on the brand owner or importer. If you only distribute or resell, or if your role in the supply chain is unclear, confirm who counts as the producer with the Colorado Department of Public Health and Environment (CDPHE) before relying on a screening result.
Exemption thresholds
The reviewed rules list two exemption tests for Colorado, and meeting any one of them points to a likely exemption:
- Global gross revenue below $5,506,200 (approx., adjusted annually).
- Covered materials into Colorado below 907.18 kg per year. The statute says "ton"; the checker screens it as a short ton of 907.18 kg to avoid false exemptions.
The tests are alternatives: a large brand shipping very little packaging into Colorado can be exempt on weight alone, and a small brand can be exempt on revenue alone. If neither test is met, the checker shows a likely obligation, and the next step is to confirm producer and material scope with the agency.
Key dates
Fees apply from Jan 2026. The reviewed rules do not list a separate registration deadline for Colorado; confirm current reporting deadlines with CDPHE, since deadlines depend on the reporting year and program cycle.
What to confirm
The revenue figure needs care: $5,506,200 comes from a Wine Institute secondary-source update dated 2026-10-13, below the earlier $5.78M figure, and is still pending CDPHE confirmation. CDPHE adjusts the threshold annually, so check the current-year figure with CDPHE before relying on it.
