California packaging EPR
Status: Registration/reporting; full fees from 2027.
Who must comply
California's program covers producers of covered packaging sold into the state. The USAEPR checker screens brand owners and US importers as its starting point, because EPR duties usually fall on the brand owner or importer. Unlike some other states, California's small-producer exemption is not automatic: small producers must apply for the exemption through the state. If you only distribute or resell, or if your role in the supply chain is unclear, confirm who counts as the producer with CalRecycle before relying on a screening result.
Exemption thresholds
The reviewed rules list one exemption test for California: California gross sales below $1,000,000. Note that this is California sales, not global revenue — a brand with large global revenue but small California sales can still meet this test. The exemption must be claimed; meeting the figure alone does not enroll you. Apply via PEPRS under 14 CCR 18980.5.2.
Key dates
- June 1, 2026: the registration and exemption-claim deadline has passed. Late registrants should contact CalRecycle.
- 2027: full fees begin.
- 2032: even exempt small producers must plan for all packaging they sell to be recyclable or compostable by 2032 (CalRecycle).
What to confirm
Confirm the sales definition used for the $1,000,000 test, and the current late-registration instructions for the reporting year, with CalRecycle. The checker does not supply a complete deadline calendar, and deadlines depend on the state, reporting year, and program.
